Terms of Service
The rules and agreements that govern your use of Freedom.
1. Acceptance of Terms
By accessing or using Freedom (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Description of Service
Freedom is a software platform for political and advocacy organizations to coordinate field organizing, including canvassing, contact management, surveys, and related activities. The Service is provided "as is" and may evolve over time.
3. Accounts
You must create an account to use most features. You are responsible for:
- Providing accurate, current, and complete information.
- Maintaining the confidentiality of your credentials.
- All activity under your account.
- Notifying us immediately of any unauthorized use.
We may suspend or terminate accounts that violate these Terms or pose a risk to the Service or other users.
4. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose or in violation of applicable election, privacy, or telecommunications laws.
- Upload data you do not have the right to use, including voter data obtained without authorization.
- Harass, threaten, or harm others.
- Attempt to gain unauthorized access to the Service or related systems.
- Reverse engineer, decompile, or disassemble the Service except as expressly permitted by law.
- Use the Service to send spam, malware, or unsolicited communications.
- Resell or redistribute the Service without our written permission.
5. Your Content
You retain ownership of all data and content you submit to the Service ("Your Content"). You grant us a limited, non-exclusive, royalty-free license to host, store, process, and display Your Content solely to provide the Service.
You are solely responsible for Your Content and represent that you have all rights necessary to upload it. We may remove content that violates these Terms or applicable law.
6. Subscription and Payment
Paid plans are billed in advance on a monthly or annual basis. By subscribing, you authorize us to charge your chosen payment method on a recurring basis. Fees are non-refundable except where required by law.
You may cancel at any time. Cancellations take effect at the end of the current billing period. You will continue to have access until that date.
7. Free Trials
We may offer free trials. Trials automatically convert to paid subscriptions unless cancelled before the trial ends. Trial features may be limited.
8. Intellectual Property
The Service, including all software, designs, logos, and trademarks, is owned by us or our licensors and protected by intellectual property laws. Except for the limited license to use the Service granted in these Terms, no rights are granted to you.
9. Third-Party Services
The Service may integrate with or link to third-party services (such as identity providers, mapping providers, and payment processors). We are not responsible for third-party services and your use of them is governed by their own terms.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS (USD $100), WHICHEVER IS GREATER.
12. Indemnification
You agree to indemnify and hold harmless Freedom and its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms or applicable law.
13. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, including for breach of these Terms. Upon termination, your right to use the Service ceases. Sections that by their nature should survive termination will survive.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.
15. Changes to These Terms
We may modify these Terms from time to time. Material changes will be communicated by email or in-product notice. Continued use of the Service after changes take effect constitutes acceptance.
